The following Terms & Conditions of Use together with our privacy policy (collectively, Terms) form the agreement between You and Us in relation to Your use and access of this website and the supply of wine ordered by the website. By accessing this website, You acknowledge that You are 18 years or older and have read and understood the Terms and that You agree to be bound by the Terms. If You do not agree to the Terms or have not reached 18 years of age then you must not use this website. From time to time We may vary the Terms and You must accept the Terms on each occasion You access the website. “Our” , “We” , and “Us” means PACIFIC DISTILLERY Pty Ltd and “You” and “Your” means the customer having an account with Us or placing an order with us.
ORDERING
The delivery address supplied by You must be in Australia. We are not permitted to ship product internationally. Due to legislation we DO NOT ship to the Northern Territory.
By placing an order with Us You are confirming that You are 18 years or older. It is illegal for Us to sell alcohol to anyone under the age of 18.
When You give Us Your credit or debit card details You are confirming that You are either the card holder, or that You have permission from the card holder to use the card for the purpose of ordering pacific alcohol beverages from Us.
The delivery address supplied by You must be in Australia. We are not permitted to ship product internationally.
payment will be taken from Your card at the time of purchase or when your monthly VIP subscription (if You are a VIP customer) is due.
We reserve the right to cancel any orders We cannot fulfill for any reason. If Your order is cancelled We will contact You to inform You of the cancellation and refund any money You have paid Us for that order. We only ship in cases containing 16 CANs.
PRODUCT AVAILABILITY
Products offered by Us are displayed on Our website(s) in ‘real time’ . Any product may be withdrawn from offer without notice at Our discretion.
We reserve the right to limit sales to retail quantities if we reasonably deem that the order is not within a reasonable retail quantity. If you wish to purchase unusually large orders for an event, please contact us BEFORE placing the order so that we can accommodate you.
PRE-ORDERS
We occasionally invite you to pre-order new items in our range or items that are currently out of stock.
This will appear just like any regular order would, in your order history as a pre-order with expected dispatch date.
We will email to let you know when Your order is ready to ship, then email Your shipping information when dispatched.
Please note, pre-order delivery dates are estimates and subject to change. If there’s a delay, we’ll let you know by email.

VIP SUBSCRIPTIONS
Pacific Distillery offer VIP subscriptions to its VIP members, where you can set a regular order, shipped as frequently as you request. Your Credit card will be
charged when the order is dispatched. As an appreciation for your ongoing support, VIP Subscribers will receive invites to our exclusive Research and Development taste testing events.
EVENTS
Each Event is a standalone production. Therefore, access to Event Tickets are managed by the Policies and procedures of each event.
Events will be marketed to our VIP members before through our social media. Ticketing platform TBA at the time of each event. Age Restrictions Due to licensing laws, no one under 18 is permitted at the event – this includes babies and children in pushchairs. Valid photo ID is required for entry. Failure to provide proof of age may result in denied entry. Responsible Alcohol Service Pacific Distillery and the venue staff reserve the right to refuse service or remove any individual who becomes overly intoxicated. Zero Tolerance Policy Abuse towards staff or other attendees will not be tolerated and you will be asked to vacate the venue. Pacific Distillery reserves the right to revoke membership in cases of inappropriate behaviour. Photography & Filming We may capture photos or videos during the event, and you might appear. If you’re not comfortable with your image being used on our website, social media or in promotional materials, just let one of the team know on the day. Event Cancellation If we need to cancel an event for any reason, we’ll notify you via email and refund the ticket price to your account. Refunds may take a few days to process. Unfortunately, we cannot reimburse any personal expenses such as hotels or travel costs. Health & Safety Your safety is our priority. Please follow any instructions from venue staff during the event, and be mindful of others. If you’re feeling unwell or unable to attend, please let us know in advance.

Pacific Distillery, its service providers and the mobile carriers supported by the program are not liable for delayed or undelivered messages. Cancellation You may opt out at any time by contacting us at contact@pacificdistillery.com.au You may also text the keyword STOP , END, CANCEL, UNSUBSCRIBE or QUIT to cancel. After texting STOP , END, CANCEL, UNSUBSCRIBE or QUIT to our shortcode or phone number you will receive one additional message confirming that your request has been processed. You acknowledge that our text message platform may not recognise and respond to unsubscribe requests that do not include the STOP , END, CANCEL, UNSUBSCRIBE or QUIT keyword commands and agree that Pacific Distillery and its service providers will have no liability for failing to honour such requests.
SECURITY, PRIVACY AND RISK
For Your own safety We reserve the right to contact Your card issuer for the purposes of carrying out security checks. We take Your privacy very seriously and will only pass Your delivery details to 3rd parties when necessary to fulfill your order i.e. to warehouse operators, carriers and other third parties contracted to dispatch your order to You. Please read Our Privacy Policy on our website. You must not upload any type of virus or computer malware onto the website and must ensure that Your computer remains safe and does not infect Our website whilst You are on the website. We may provide links on Our website to third party products and/or services. We do not promote or recommend these products and/or services to You. If You post a comment on any of the public walls incorporated within the Pacific Distillery website or social media sites, Your comments will be in the public domain and will be visible to anyone who visits the site. You must not post a comment that is offensive, unlawful, obscene or defamatory. You are solely responsible for all posts listed using your account, whether the post was authorised or not. If you post a comment on our Website, Insta, Facebook page or TikTok, you agree that we can publish the post to promote the Pacific Distillery, without the need to reference you when we do so, even though we probably will. We have to remove content that is unlawful or breaches advertising standards. Pacific Distillery ratings and comments posted on Your ‘Pacific Distillery’ profile page may be fed through to the relevant spcial media pages, and therefore visible to anyone who visits the site. If You do not want Your Pacific Distillery wall conversations to be visible, then You must set your profile to ‘private’.

All content displayed or comprising the website, including without limitation the images, brand names, trademarks, commentary, website layout and software are subject to intellectual property protection in Australia and internationally. You do not have permission to modify the content on this website, permit unauthorised users to access it (whether intentionally or otherwise) or transmit it to third parties. Any misuse of Our intellectual property rights and/or Our partners’ intellectual property rights will result in immediate termination of Your account, and You may be liable for damages.

Information contained on our website is uploaded regularly. We cannot guarantee the information to be correct, current or complete as there are a number of factors which affect this information. We accept no responsibility or liability for any inaccuracies or typographical errors on our website.
PRODUCT WARRANTY
We warrant that the product supplied by Us is of merchantable quality when delivered to You. To the extent permitted by law We expressly disclaim all express, implied, statutory warranties, guarantees and representations. In accordance with Our terms and conditions, Our warranty given in respect of merchantable quality is limited to the replacement or resupply of the affected product to You or a refund of the cost of the product, at Our discretion.
LIABILITY
You acknowledge that We are not liable to You under any circumstances for any loss, damage or expense (including indirect or consequential, loss of opportunity or profits)You may incur from using our website. To the extent that the above exclusion of liability is unenforceable, invalid or ineffective then our aggregate liability to You under these Terms for all exclusions referred to above for all and any causes of action (collectively) shall be limited to AU$50.
INDEMNITY
You agree to indemnify, defend and hold Us, Our officers, employees, partners, suppliers, agents and contractors from and against all losses, proceedings, charges and costs (whether direct, indirect, special, exemplary or consequential) of every kind made against Us due to Your use, misuse or access to Our website and/or in allowing (with or without intention or knowledge) a person under 18 years of 18 access to Our website or to take delivery of the product on your behalf (whether with or without your permission).
FORCE MAJEURE
We shall not be responsible to You if we are unable to deliver Your order or if we are prevented from performing our obligations under these Terms due to circumstances beyond our reasonable control. We will notify you of any delays to your delivery. However, if we are prevented from performing our obligations beyond a reasonable time then we may, at our discretion, elect to cancel Your order and provide a refund or credit to the value of the cancellation without further liability to You.
ENTIRE AGREEMENT
These Terms contain the entire agreement between You and Us for the use of Our website to purchase product. All and any other understandings, agreements and representations are hereby expressly excluded.
SHIPPING POLICY
Pacific Distillery process all orders within 3-5 working days. Within Australian Capital Cities your delivery will be received within 7-14 days. In more remote, and regional, areas this can take longer.Due to Northern Territory Government legislative changes to the Liquor Amendment Bill in order to regulate the sale, provision, promotion and consumption of liquor within the Northern Territory, we do not ship to this region. Please allow up to 21 working days to receive an order. Tracking numbers will be provided on your shipping confirmation email and these can be used to track your order with Australia Post. You can check your estimated delivery time on the Australia Post website.
Orders will be sent to the delivery address that you have submitted with your order. We cannot be held responsible if that delivery address is incorrect.
We use only reputable delivery companies, however, we do not accept any liability for delayed delivery caused by any third party.
Missing or non delivered parcels need to be reported to us within 30 days within Australia. Any orders returned to us due to incorrect delivery address or unclaimed through the post office will be refunded for the product component only. You need to contact us to arrange redelivery within 30 days of dispatch, after which the refund will processed automatically.
Shipping charges incurred in connection with the return of a product are non-refundable. You are responsible for paying the costs of shipping and for the risk of loss of or damage to the product during shipping, both to and from Pacific Distillery. Damaged items If you received a damaged product, please notify us immediately for assistance. Sale items Unfortunately, sale items cannot be refunded. Only regular price items can be refunded.
